By accessing or using the Website, you agree to these Terms. If you do not agree, please do not use the Website.

These Terms govern use of the public Website only. They are not a contract for any development, consulting, or other professional services, and they do not replace any proposal, statement of work, service agreement, or other signed contract that may govern an engagement between us and a client.

You agree not to:

  • Use the Website in any way that breaches applicable law or these Terms.
  • Copy, reproduce, republish, distribute, or exploit any part of the Website except as expressly permitted.
  • Scrape, harvest, data-mine, or systematically extract content or data from the Website.
  • Introduce malware, or otherwise interfere with, disrupt, overload, or attempt to gain unauthorised access to the Website, its servers, or connected systems.

  • Use the Website to transmit unsolicited advertising, spam, or unlawful material.

We may suspend, restrict, or withdraw access to the Website (or parts of it) at any time where we reasonably consider it necessary.

3. Intellectual property

3.1 Our Website content

All text, branding, design, layout, graphics, code, and other content on the Website is owned by us or our licensors and is protected by intellectual property laws. Except where expressly permitted, you may not copy, reproduce, modify, distribute, or create derivative works from any Website content without our prior written permission.

3.2 Third-party trademarks and technologies

Third-party names, trademarks, logos, and technologies referred to on the Website are the property of their respective owners. Their appearance on the Website does not imply any endorsement or affiliation unless expressly stated.

3.3 Client material displayed with permission

Where the Website displays client logos, case studies, testimonials, or other client-owned material, that material remains the property of the relevant client and is displayed with their permission.

3.4 Intellectual property in client projects

Ownership of intellectual property in paid client work is governed by the applicable client agreement, not by these Terms. As a general matter, and subject always to the specific agreement:

  • The code developed for a project is owned by the agency (us).
  • Components created specifically and uniquely for a particular project are not reused across other projects.
  • General, reusable, non-client-specific components, tools, libraries, templates, and methods may be reused across multiple projects.

The precise ownership, licence, and reuse terms for any given engagement are set out in the relevant client agreement and take precedence over this general summary.

4. Enquiries and submitted material

Sending us an enquiry through the Website or by email does not create any contract or oblige either party to enter into one.

Please do not send us confidential or proprietary information through the Website's contact form. Confidential project information should be shared later in an engagement through direct communication and, where appropriate, under a non-disclosure agreement.

If you send us any ideas, suggestions, or materials that are not confidential and not covered by a specific agreement, you accept that we may use them for the purpose of responding to your enquiry and operating our business, without that creating any obligation or liability on our part, and without acquiring rights in your own pre-existing intellectual property.

How we handle personal data contained in enquiries is explained in our Privacy Policy.

5. No professional advice; nature of Website content

The content on the Website is provided for general information only. It does not constitute professional, legal, financial, or technical advice, and should not be relied upon as such.

Descriptions of our capabilities, services, methods, or past work are illustrative. They are not binding offers, promises, or guarantees of any particular outcome, result, timeline, or performance.

6. Engagements are governed by separate agreements

Any actual engagement with us is subject to a separate agreement, not to these Terms. In particular:

  • Our initial consultation is provided before any binding engagement.
  • A project begins only once the applicable commercial agreement (for example, a proposal, statement of work, or service agreement) has been accepted.
  • Timelines, deliverables, fees and payment terms, ownership and licences, warranties, maintenance, confidentiality, and acceptance criteria are all governed by the relevant client agreement — not by the Website or these Terms.

For clarity, information shown on the Website (including any pricing, tiers, add-ons, or maintenance information for our custom-website services) is indicative and is confirmed and made binding only through the applicable client agreement.

Depending on the engagement, separate documents may apply, such as a Master Services Agreement, Statement of Work, Non-Disclosure Agreement, and/or Data Processing Agreement.

7. AI-assisted work

We use AI-assisted tools as part of our development process. AI-generated or AI-assisted outputs may require human review and should not be treated as infallible. Any AI-related aspects of a client engagement, including data handling and safeguards, are addressed in the relevant client agreement rather than on the Website.

The Website may link to, or reference, third-party websites, platforms, or services. We do not control these and are not responsible for their content, availability, security, or practices. Accessing a third-party website or service is at your own risk and may be subject to that third party's own terms and privacy policies.

The availability and performance of third-party platforms and services are outside our complete control.

9. Availability and accuracy

We aim to keep the Website available and its content accurate and up to date, but we do not guarantee that the Website will be uninterrupted, error-free, secure, or free from viruses, or that its content is complete, current, or accurate at all times. We may change, suspend, or discontinue any part of the Website at any time without notice.

10. Limitation of liability

To the fullest extent permitted by applicable law:

  • We provide the Website "as is" and "as available", without warranties of any kind, whether express or implied.
  • We are not liable for any indirect, incidental, special, or consequential loss, or for any loss of profits, revenue, data, goodwill, or business, arising out of or in connection with your use of (or inability to use) the Website or reliance on its content.

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable Slovenian or EU law.

11. Changes to the Website and these Terms

We may update the Website and these Terms from time to time. The "Last updated" date shows when these Terms were last revised. Your continued use of the Website after changes take effect constitutes acceptance of the revised Terms.

12. Governing law and jurisdiction

These Terms, and any dispute or claim arising out of or in connection with them or your use of the Website, are governed by the laws of the Republic of Slovenia, without regard to conflict-of-law rules.

The courts of the Republic of Slovenia have jurisdiction over any such dispute. Subject to any mandatory rules of consumer or other applicable law, the competent court shall be the court having territorial jurisdiction over our registered seat.
